1.1 Inform Personal Training: The contractor, established in The Hague, registered with the Chamber of Commerce (KvK) under number 91172020 and VAT number NL004870965B53.
1.2 Client: The natural person who uses the services of Inform Personal Training.
1.3 Agreement: The agreement between Inform Personal Training and the Client regarding personal training, coaching, or nutritional advice.
1.4 Platform: The software environment (Trainin) used for scheduling, administration, and payments.
2.1 These General Terms and Conditions apply to all offers, sessions, and agreements between Inform Personal Training and the Client.
2.2 By creating an account, purchasing services, or participating in training sessions, the client agrees to these Terms and Conditions.
3.1 The Client is strictly obliged to truthfully provide information regarding their health, medical history, and physical condition. The Client accepts that withholding or misrepresenting such information may compromise the safety of the training and releases Inform Personal Training from liability for consequences arising from such omissions.
3.2 The Client is personally responsible for:
ᐧ Disclosing all relevant injuries, medical conditions, pregnancy, or physical limitations prior to the start of the collaboration.
ᐧ Immediately notifying the trainer of any new pain, discomfort, or changes in health status before or during a session.
ᐧ Consulting a physician or medical specialist if they are unsure about their ability to participate in physical exercise.
3.2 Inform Personal Training reserves the right to refuse a Client if the health screening indicates risks that fall outside the trainer’s scope of practice.
4.1 Sessions are scheduled by mutual agreement or via the Platform.
4.2 24-Hour Cancellation Policy: If the Client is unable to attend, they must cancel the session at least 24 hours in advance via the Platform or WhatsApp.
4.3 If a session is cancelled less than 24 hours before the start time, or if the Client fails to show up ("No-show"), the full price of the session will be charged or deducted from the Client’s credits. Exceptions to this rule (e.g., in cases of sudden emergency) are at the sole discretion of Inform Personal Training.
4.4 Inform Personal Training reserves the right to refuse reservations or terminate the relationship with immediate effect if the client repeatedly fails to show up as scheduled or repeatedly cancels.
5.1 Rates: The applicable rates are those displayed in the Platform or communicated at the time of booking or purchase. Prices mentioned on the public website may be indicative or listed as "starting from" rates. All prices include VAT (BTW).
5.2 Payment Methods: Payment must be made via the digital payment methods provided by Inform Personal Training.
5.3 Payment Terms:
5.3.1 Single Sessions & Packages: Payment is due immediately upon booking or purchase. The full amount must be settled prior to the start of the session.
5.3.2 Memberships: Membership fees are collected periodically (e.g., monthly) via automatic direct debit.
5.4 Late or Failed Payments: If a direct debit fails (reversal) or payment is not received on time, Inform Personal Training reserves the right to suspend the Client’s access to training sessions until the outstanding amount is paid.The Client remains liable for all outstanding fees even during a period of suspension.
5.5 Price Adjustments: Inform Personal Training reserves the right to index or adjust prices. Clients will be notified at least 30 days in advance of any price changes.
6.1 Credit Packs (Rittenkaarten): Have a limited validity period as stated at the time of purchase in the Platform. Unused credits expire automatically after this period and are non-refundable.
6.2 Memberships: Credits are issued per period (e.g., monthly). Unused credits cannot be carried over to the next period unless explicitly stated in the specific membership details.
7.1 Personal Service: Because Inform Personal Training offers a dedicated personal service, sessions are conducted exclusively by your trainer.
7.2 Unforeseen Absence: In the rare event that the trainer is ill or unable to attend due to unforeseen circumstances, the session will be rescheduled to a mutually convenient time. The Client retains their session credit to be used for this new appointment.
7.3 Holidays: Inform Personal Training will announce holiday periods at least 2 weeks in advance. During these periods, training sessions may be paused. While Inform Personal Training may occasionally offer a substitute trainer, this is not guaranteed. If no training takes place, memberships or credits will be extended or paused accordingly so no value is lost.
8.1 Participation in training is entirely at the Client’s own risk.
8.2 Inform Personal Training undertakes an obligation of best effort (inspanningsverplichting) to guide the Client safely and effectively, but does not guarantee specific physical results (resultaatsverplichting).
8.3 Inform Personal Training is not liable for any physical injury, material damage, or loss of personal property during sessions, except in cases of proven intent or gross negligence by the trainer.
8.4 The Client is responsible for having their own third-party liability insurance and health insurance.
9.1 Personal data is processed in accordance with the GDPR (Dutch AVG). See the Privacy policy.
9.2 Training plans and nutritional advice provided remain the intellectual property of Inform Personal Training and may not be shared with third parties for commercial purposes.
10.1 These terms are governed exclusively by Dutch Law.
10.2 Disputes will be submitted to the competent court in The Hague (Den Haag).
